PROSECUTOR: DRIVER WHO FATALLY HIT TEXAS DEPUTY WAS DRUNK

A driver who fatally hit a deputy constable working a funeral procession was intoxicated, officials told KPRC Local 2 Friday. Precinct 7 Deputy David Joubert, 60, was on a motorcycle when a car turned in front of him on Cullen Street and hit him on Jan. 12. Douglas Grayer, 49, has been charged with intoxication manslaughter and vehicular manslaughter.

"He made an illegal U-turn on Cullen to go and talk to a female he saw walking alongside the road," Prosecutor Warren Diepraam said. Investigators said Joubert went over the car, was run over and then dragged for nearly a block.

Diepraam said Grayer should not have been behind the wheel of a car in his condition. "The results came back at a .045 (percent)," Diepraam said, speaking about the driver's blood alcohol level. "This is two and a half hours after the crash. Using the information obtained at the scene, it was determined that at the time of driving, the defendant was a .08 to a .09."

Grayer is out on bond and set to appear in court in early April. He was convicted of driving with a suspended license in 1985.
